Welcome to ATX Africa. These Terms of Use ("Terms") govern your access to and use of the ATX Africa website, marketplace, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use our Platform.

1. Acceptance of Terms

By registering an account, browsing listings, posting services, or interacting with the ATX Africa ecosystem as a tour operator, travel agency, corporate partner, or individual traveler ("User"), you signify that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

2. Account Registration & Eligibility

Eligibility: You must be at least 18 years of age to create an account and use our services.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
Accurate Information: All information provided during registration—whether for a free Beginner Plan, a Professional Plan, or a Custom Enterprise account—must be accurate, current, and complete.

3. Subscription Plans, Fees, and Payments

ATX Africa offers both free and paid subscription models to cater to travel suppliers and trade partners:

Beginner Plan: Free of charge, including a limited number of posting packages (3 packages).
Professional Plan: Billed at $50 USD per month or $500 USD annually, granting up to 50 posting packages. Customers and global buyers can access and view these listings free of charge.
Billing & Renewals: Paid subscriptions automatically renew unless canceled prior to the renewal date. All fees are non-refundable except as required by law or specified in our refund policy.
Price Modifications: ATX Africa reserves the right to modify subscription fees or plan structures with reasonable notice provided to active users.

4. User Content & Marketplace Conduct

Postings & Itineraries: Suppliers are solely responsible for the accuracy of their listings, pricing, availability, and descriptions (safaris, DMCs, tours, etc.).
Prohibited Content: Users shall not upload, post, or transmit any content that is fraudulent, defamatory, infringes on intellectual property rights, violates local or international laws, or promotes illegal activities.
Marketplace Integrity: ATX Africa acts as a bridge connecting suppliers, travel professionals, and travelers. We do not directly operate third-party tours or accommodations listed on the platform unless explicitly stated.

5. Intellectual Property Rights

All content included on the Platform—such as text, graphics, logos, button icons, images, audio clips, and software—is the property of ATX Africa or its content suppliers and is protected by international copyright and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without express written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, ATX Africa, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform or third-party transactions facilitated through it.

7. Termination

We reserve the right to suspend or terminate your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including breach of these Terms. Upon termination, your right to use the Platform will cease immediately.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will indicate the "Effective Date" at the top of this page when updates are made. Your continued use of the Platform following any changes constitutes acceptance of those changes.
